1. Introduction

These Terms of Use (“Terms”) govern your access to and use of the HEM Academy website, membership platform, Digital Masterclass Library, and any related content, products, or services (collectively, the “Platform”).

The Platform is owned and operated by HEM Financial Group LLC, a financial, business, and technology consulting firm, doing business through the brand HEM Academy (“HEM,” “we,” “our,” or “us”).

By accessing or using the Platform in any way, including by visiting our website, creating an account, purchasing HEM Membership, or participating in any program, you agree to be legally bound by these Terms. If you do not agree, you must not use the Platform. These Terms apply to all users of the Platform, including members, visitors, Expansion Agents, Expansion Leaders, affiliates, corporate partners, and any other participants.

2. Eligibility

To use the Platform, you must:

  • Be at least 18 years old, and
  • Have the legal capacity to enter into a binding agreement under the laws of your country of residence.

By using the Platform, you represent and warrant that you meet these requirements.

3. Educational Purpose Only – No Advice

HEM Academy is an educational platform. All content, including but not limited to masterclasses, videos, written materials, templates, live sessions, and events (collectively, “Content”), is provided for general educational and informational purposes only.

Nothing on the Platform constitutes or should be interpreted as:

  • Legal advice
  • Tax advice
  • Investment advice
  • Financial planning or fiduciary advice
  • Career, employment, or HR advice
  • Medical, nutritional, or psychological advice

You agree that:

  • No client–advisor, fiduciary, or professional relationship is created by your use of the Platform.
  • You are solely responsible for your decisions.
  • You should consult qualified professionals before making any legal, financial, tax, medical, or other decisions.

4. Language of the Content

For now, all masterclasses and educational sessions are delivered in Spanish. The website interface, menus, and legal pages are available in English and may be made available in Spanish as a translation convenience.

If there is any inconsistency between language versions of these Terms or other legal documents, the English version will prevail.

5. Accounts, Security, and Acceptable Use

To access certain areas or features, you may be required to create an account.

You agree that:

  • You will provide accurate, current, and complete information when creating your account.
  • You are fully responsible for maintaining the confidentiality of your login credentials.
  • You will not share your username, password, or access with any other person.
  • You will immediately notify us at info@hemacademyglobal.com if you suspect any unauthorized access or misuse of your account.

Your account is personal and individual. Sharing, reselling, or “group access” under a single login is strictly prohibited. Accounts that appear to be shared or misused may be suspended or terminated at our discretion, without refund.

You agree not to:

  • Use the Platform for any unlawful purpose;
  • Harass, threaten, abuse, or harm other users or HEM staff;
  • Attempt to interfere with or compromise the security or integrity of the Platform;
  • Upload or transmit viruses, malware, or any harmful code;
  • Use automated systems (bots, scrapers) to access or copy content without written permission.

6. HEM Membership – Billing, Renewal, and Refunds

HEM Membership is an annual digital membership that gives you access to standard masterclasses, events, and core programs as described on the website.

By purchasing HEM Membership, you agree to the following:

  1. Billing & Auto-Renewal
    • You will be charged the membership price in U.S. Dollars (USD) at the time of purchase.
    • Your membership is set to automatic yearly renewal using the payment method you provide, until you cancel.
    • Membership prices may change for future periods. Any change will be communicated or reflected on the checkout page before renewal.
  2. Cancellation
    • You may cancel your membership at any time from inside your account.
    • To avoid renewal, you must cancel before your renewal date.
    • After cancellation, your access will remain active until the end of the paid period.
    • Your membership will not renew for the following year.
  3. All Sales Are Final – No Refunds
    • All membership purchases are final and non-refundable.
    • We do not offer partial refunds, credits, or pro-rated amounts for unused time or content.
  4. Taxes and Currency
    • Prices are listed in USD. Your bank or payment provider may convert charges to your local currency and may apply additional fees.
    • Where required by law, applicable taxes may be added at checkout.

7. Corporate Membership & Premium Programs

We may offer Corporate Membership and other Premium Programs (such as the HEM Business Accelerator, Sponsorship & Visibility Program, and Share & Earn Program) under separate proposals or agreements.

  • Corporate Membership allows a company or organization to sponsor HEM Membership for a group of women.
  • All terms, pricing, and responsibilities for Corporate Membership and Premium Programs are defined in separate written agreements or proposals between the organization and HEM Financial Group LLC.
  • In the event of a conflict between these Terms and a separately signed agreement, the signed agreement will control for the specific program covered by that agreement.

8. Share & Earn Program, Expansion Agents, and Leaders

The Share & Earn Program and roles such as Expansion Agent and Expansion Leader are independent-contractor opportunities to promote HEM Academy.

By applying to or participating in these programs, you acknowledge and agree that:

  • You are not an employee of HEM Financial Group LLC, HEM Academy, or any related entity.
  • You will not receive employee benefits (such as salary, insurance, or paid time off).
  • You are responsible for reporting and paying your own taxes and complying with applicable laws.
  • Commissions are paid on qualifying sales only, and there are no income guarantees.

You further agree to:

  • Use only approved branding, logos, and official materials;
  • Not make false promises or misleading statements (including “get rich quick” claims);
  • Not spam, harass, or pressure potential members;
  • Comply with all guidelines and policies for affiliates and Expansion Agents, as may be updated from time to time.

We may modify, suspend, or terminate the Share & Earn Program or your participation in it at any time, with or without cause, subject to payment of any commissions properly earned and due under the program rules.

9. Intellectual Property

All content on the Platform, including but not limited to text, videos, audio, graphics, logos, designs, digital downloads, and software, is the property of HEM Financial Group LLC, HEM Academy, or our licensors, and is protected by copyright, trademark, and other intellectual property laws.

When you purchase HEM Membership or access the Platform, we grant you a limited, non-exclusive, non-transferable, revocable license to use the content for your personal, non-commercial educational use only.

You may not, without prior written permission:

  • Reproduce, distribute, sell, or publicly display any content;
  • Create derivative works based on our content;
  • Share course files, videos, or materials outside of your personal account;
  • Use our name, logo, or brand to imply endorsement of your own products or services.

Instructors who provide content to HEM Academy grant us a license to host, use, adapt, and distribute their content within the Platform and related promotional materials, under the terms of their separate agreements.

10. Payments, Third-Party Services, and Integrations

We use third-party service providers (such as payment processors, learning management systems, email providers, and analytics tools) to operate the Platform.

By using the Platform, you acknowledge that:

  • Payments are processed by third-party providers (e.g., Stripe, paypal), and we do not store full payment card details.
  • Third-party services are governed by their own terms and privacy policies.
  • We are not responsible for errors, outages, or security incidents of third-party providers.

11. No Guarantees – Results May Vary

HEM Academy cannot and does not guarantee:

  • Specific personal changes or emotional outcomes;
  • Job offers, promotions, or career advancements;
  • Business revenue, profits, or clients;
  • Financial returns or investment outcomes.

Your results will always depend on your personal situation, decisions, and the time and effort you invest. You are solely responsible for applying what you learn. Testimonials and case studies shared on the Platform represent individual experiences. They are not typical and are not guarantees of future results for you or anyone else.

12. Limitation of Liability

To the fullest extent permitted by law:

  • HEM Financial Group LLC, HEM Academy, and their owners, directors, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill, arising from or related to your use of the Platform.

If, despite these limitations, we are found liable to you for any claim in connection with the Platform, our total aggregate liability to you will not exceed the total amount you paid to us for HEM Membership or programs in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations; in those cases, our liability will be limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless HEM Financial Group LLC, HEM Academy, and their owners, officers, directors, employees, contractors, and agents from and against any and all claims, demands, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • Your use or misuse of the Platform;
  • Your breach of these Terms;
  • Your violation of any law or the rights of any third party.

14. Governing Law and Jurisdiction

These Terms and any dispute arising out of or in connection with them will be governed by and interpreted in accordance with the laws of the State of Connecticut, USA, without regard to conflict of law principles. Any legal action or proceeding related to the Platform shall be brought exclusively in the state or federal courts located in Connecticut, USA, and you consent to the jurisdiction of such courts.

15. Changes to These Terms

We may update or modify these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page and may provide additional notice as appropriate.

Your continued use of the Platform after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Platform.
